An immigration judge in Baltimore has denied Kilmar Ábrego García’s bid for asylum on Thursday, but he has 30 days to appeal.

Ábrego’s case has drawn national attention since the 30-year-old was wrongfully deported by the Trump administration to El Salvador in March. The Salvadorian national has an American wife and children and has lived in Maryland for years, but he originally immigrated to the US without proper documentation as a teenager.

Salvadorian refused offer of deportation to Costa Rica before he was released to await trial on human smuggling charges

US immigration officials said they intend to deport Kilmar Ábrego García to Uganda, after he declined an offer to be deported to Costa Rica in exchange for remaining in jail and pleading guilty to human smuggling charges, according to a Saturday court filing.

The Costa Rica offer came late on Thursday, after it was clear that the Salvadorian national would probably be released from a Tennessee jail the following day.

The president of El Salvador has denied claims that Kilmar Ábrego García was subjected to beatings and deprivation while he was held in the country before being returned to the US to face human-smuggling charges.

Nayib Bukele said in a social media post that Ábrego García, the Salvadorian national who was wrongly extradited from the US to El Salvador in March before being returned in June, “wasn’t tortured, nor did he lose weight”.

New court documents allege physical and psychological torture at Cecot in one of first looks at conditions in prison

Kilmar Ábrego García, the Maryland man who was wrongfully deported to El Salvador and detained in one of that country’s most notorious prisons, was physically and psychologically tortured during the three months he spent in Salvadorian custody, according to new court documents filed Wednesday.

While being held at the so-called Terrorism Confinement Center (Cecot) in El Salvador, Ábrego García and 20 other men “were forced to kneel from approximately 9:00 PM to 6:00 AM”, according to the court papers filed by his lawyers in the federal district court in Maryland.

An appeals court has ordered the Trump administration to return a man wrongfully deported to El Salvador to the US and to explain how it is complying in a ruling apparently designed to break a pattern of apparent government defiance of judicial orders.

The US court of appeals for the second circuit in New York also required the government to provide a declaration of the current whereabouts and custodial status of Jordin Melgar-Salmeron, who was deported on 7 May less than half an hour after the court had expressly barred his removal.

The Trump administration is invoking the “state secrets privilege ” in an apparent attempt to avoid answering a judge’s questions about its erroneous deportation of Kilmar Ábrego García to El Salvador.

US district judge Paula Xinis disclosed the government’s position in a two-page order on Wednesday. She set a Monday deadline for attorneys to file briefs on the issue and how it could affect Ábrego García’s case. Xinis also scheduled a 16 May hearing in Greenbelt, Maryland, to address the matter.

The Trump administration has been in touch directly with the Salvadorian president Nayib Bukele in recent days about the detention of Kilmar Ábrego García, the man wrongly deported to a notorious prison in El Salvador, according to two people familiar with the matter.

The nature of the discussion and its purpose was not clear because multiple Trump officials have said the administration was not interested in his coming back to the US despite the US supreme court ordering it to “facilitate” Ábrego García’s release.

A federal judge on Wednesday again directed the Trump administration to provide information about its efforts so far, if any, to comply with her order to retrieve Kilmar Ábrego García from an El Salvador prison.

The US district judge Paula Xinis in Maryland temporarily halted her directive for information at the administration’s request last week. But with the seven-day pause expiring at 5pm, she set May deadlines for officials to provide sworn testimony on anything they have done to return Ábrego García to the US.
