Donald Trump’s defamation trial against E Jean Carroll resumes in New York today after a juror’s illness delayed proceedings. But the biggest question isn’t whether Trump will be found liable (he already was) or even how much he’ll have to pay her (it could be a lot). It’s how he’ll behave – and what, if anything, the judge can do to rein him in.

The last time Trump was in court, he grumbled so loudly from his seat that the judge, Lewis Kaplan, warned him he could be kicked out of court. “Mr Trump has the right to be present here. That right can be forfeited, and it can be forfeited if he is disruptive,” he said. “Mr Trump, I hope I don’t have to consider excluding you from the trial.”

Microsoft lays off 1,900 Activision Blizzard and Xbox staff

Microsoft is cutting around 1,900 jobs at Activision Blizzard and Xbox this week, per an internal memo from the head of the company’s gaming division.

The cuts represent around 9% of the overall Microsoft Gaming division, which employs roughly 22,000 people, with most of the layoffs set to happen at video game publisher Activision Blizzard. The president of the subsidiary, Mike Ybarra, is also leaving the company. Microsoft did not immediately respond to a Reuters request for comment.

Carl Andre, the minimalist sculptor whose life’s work was overshadowed by accusations that he had murdered his third wife, has died aged 88.

The artist was a pioneer of minimalism, and famed for austere works such as 1966’s Equivalent VIII, an arrangement of 120 fire bricks on the gallery floor. But he was also notorious for being a suspect in the murder of Ana Mendieta, who fell from the couple’s apartment window after an argument in 1985. Despite being acquitted of second-degree murder in 1988, the accusations continued to follow Andre for the rest of his life, with supporters of Mendieta turning up to protest at his exhibitions.

The former Trump adviser Peter Navarro faces sentencing on Thursday on two counts of contempt of Congress, arising from his refusal to comply with a subpoena from the House committee that investigated the January 6 attack on Congress.

The mandatory minimum sentence is two months in prison, one for each count. Prosecutors in the case, which saw Navarro convicted in federal court in Washington DC in September, asked for 12 months prison time and a $200,000 fine.

The Federal Aviation Administration (FAA) has approved an inspection and maintenance process to allow grounded Boeing 737 Max 9 planes to return to service, following a cabin panel blowout on an Alaska Airlines flight.

“The exhaustive, enhanced review our team completed after several weeks of information gathering gives me and the FAA confidence to proceed to the inspection and maintenance phase,” FAA administrator Mike Whitaker said in a statement.

The electric vehicle manufacturer brought in $25.1bn in revenue and posted $.71 in earnings a share in the fourth quarter of 2023, missing analyst expectations of 25.76bn in revenue and $0.74 earnings a share. The company’s fourth quarter revenue increased 3% year over year from $24.3bn in 2022.

Ohio’s state senate has voted to override the governor Mike DeWine’s veto of a bill that bans transgender minors from receiving gender-affirming care, and their ability to play on sports teams, on Wednesday.

The bill, HB68, prohibits doctors from providing gender-affirming care – such as puberty blockers, hormone therapy or surgeries – to trans youths. It also blocks transgender female student athletes from participating on girls’ sports teams.

According to the Economist/YouGov poll, roughly equal numbers of adults believe Israel’s military campaign against Palestinians, which is estimated to have killed more than 25,000 people since 7 October, amounts to genocide: 35% say it is, 36% say it isn’t, with 29% undecided.

The Biden administration will reportedly pause a decision on approving what would be one of the world’s largest gas export hubs, amid concern from climate experts that greenlighting the project would create a “carbon mega bomb”.

The project, Calcasieu Pass 2, or CP2, would be positioned near the rapidly eroding Louisiana shoreline and be the biggest such export terminal in the US and part of a huge expansion of new gas infrastructure along the Gulf of Mexico.

Two ships sailing close to the Gulf of Aden were forced to seek the support of the US navy after explosions were heard nearby, as the Houthi group kept up their assault on commercial shipping off the coast of Yemen.

The Houthis have said their attacks are in solidarity with the Palestinians as Israel bombards Gaza. The ships belonging to the Danish shipping company Maersk came under attack from three anti-ship missiles near the Bab el-Mandeb strait, the US central command (Centcom) said. No damage was caused either to the Maersk Detroit or the Maersk Chesapeake.

What is not clear is where Haley could actually notch a victory against Trump. She isn’t participating in the Nevada caucuses on 8 February (she will instead be on the state’s primary ballot, which won’t lead to her winning any delegates), and polls in her home state of South Carolina – where the 24 February primary will be the next major showdown – show Trump with a huge lead.

Haley is likely to face immense pressure to depart the race in coming days. She’ll face questions about whether she’ll follow a path similar to Florida Gov Ron DeSantis, who vowed to continue on after his second-place finish in last week’s Iowa caucuses – and then he dropped out days later.
